On March 19, 2013, in Springville, New York, 16-year-old Dylan Schumaker was babysitting his girlfriend Ashlee Smith’s two young sons while she worked her shift at a restaurant. When the night ended, one of the sons was dead and Schumaker was arrested for murder. It turned out that he had beaten the older son Austin, who was just shy of turning two years old, to death.

Schumaker, convicted of second-degree murder, cried during the verdict that he didn’t mean to kill Austin and that he loved him. However, the State Supreme Court Justice M. William Boller called him a ‘manipulator and deceiver’ for his ploy to sway the jury through tears and sentenced him to 25 years to life in prison for the toddler’s death.

Dylan Schumaker is currently serving his sentence in Clinton Correctional Facility, New York – He will be eligible for parole in 2031

In February 2016, the Court of Appeals reduced Dylan Schumaker’s prison sentence to 18 years to life, making him eligible for parole in 2031 when he completes his 18 years in prison. He will, however, remain under the state’s supervision even after being released.

Schumaker, now 26 years old, has served 9 years of his indeterminate sentence since his incarceration in 2014. He is currently serving the remainder of his sentence in the Clinton Correctional Facility, New York.
